The Bankruptcy Process
While bankruptcy may have a negative connotation in our society, the process can often be highly beneficial for individuals and families that have encountered financial distress after a job loss, illness or injury, or unexpected expenses. With the recent economic crisis and poor job market, more people are turning to bankruptcy to find relief from their overwhelming debt.
At the DiTocco Law Group, PLLC, we work to provide informative and personalized advice on the bankruptcy process and the benefits a filing may provide in your specific financial situation. Our South Florida bankruptcy lawyer created our firm in an effort to provide high-quality and accessible bankruptcy guidance at affordable cost to individuals and families throughout Broward County and Palm Beach County.
What Is Chapter 7 Bankruptcy?
Chapter 7 bankruptcy is a legal process that allows for the elimination or discharge of certain unsecured debts, including those related to credit cards, medical bills, personal loans and bank lines of credit. Following the liquidation of certain nonexempt assets by the bankruptcy trustee, your unsecured debts are cleared, giving you a fresh start on a renewed financial future.
What Are The Steps In The Bankruptcy Process?
The first step in your bankruptcy proceedings is to schedule a free initial consultation to discuss your unique needs with our staff. During this consultation, we will review your situation and any applicable financial documents to determine if Chapter 7 is the right strategy for you.
Should you choose to file a Chapter 7 petition, we will assist in gathering all necessary documentation and completing the required paperwork. Because you are granted immediate benefits upon your filing, we will work to complete this step as quickly and effectively as possible.
Once your petition is filed, the bankruptcy court will review it for approval. Upon approval, the court will schedule a meeting of your creditors and appoint a trustee to oversee your proceedings.
Our staff will appear with you at the meeting of creditors, usually a formality that allows your creditors to dispute the filing, and will offer representation during any required court hearings or meetings.
How Long Does The Process Take?
From start to finish, the bankruptcy process can have you debt-free in as little as six months, though the length of your proceedings depends on your situation and the courts.
